  • Tax Filing Status

Good morning all. I have a question about filing status for taxes. My ex and I have been separated for years. We've had a separation agreement, but never filed it with the courts (that should be done this week finally). I was trying to do my own 2020 taxes with turbo tax and I'll admit I'm confused. I think I have to file as married filing separately since our agreement was not filed in the court system in any part of 2020. Because I put in married filing separately, it asked questions about him as well as me, things like "did you take out any part of your 401k contributions in 2020". I said no, because I didn't, but honestly, I have no idea (yet) what he did or didn't do. Anyway, I didn't make much in 2020, but because he makes a lot and I filed 2019 taxes with him, I didn't qualify for any stimulus money. If I understand correctly, they're now giving me a credit for that, which brought my refund up to over 2000.00. I did not hit submit because I don't have a lot of confidence in myself at this point.

My question is first, am I filing correctly as married filing separately since the agreement wasn't filed with the court for 2020 and second, what happens if I enter incorrect info on him simply because I don't know the answers to some of this? I guess I'm thinking maybe I should just file with him again this year, but based on his financial situation, I probably won't get any refund at all and I won't qualify for any stimulus money and I do not trust him.

I'm not sure how much sense I'm making. This has me pretty concerned and any input you can offer is appreciated. I'm looking forward to finally being free from all of this. Thank you!
