I have a ebay/paypal problem?

I ordered a cell phone through ebay and i paid via paypal.I couple of days later i notice the phone having problems so i take it to a local cell phone shop and they tell me that the phone is defective and the back for the cell phone is not the orginal back.I emailed the seller and he said return it for another one i returned it but haven't heard anything from him,so before the item gets to him i tell him i just want a refund instead.So now the seller has the item and my money,will i be at a lost here?

BTW i already made a paypal claim for the seller to see, i wasn't being mean in the message i left , i just stated i would please like a refund.

I think the seller is ignoring my emails about a refund.

You also have the option of filing a complaint with the Department of Human resources with your state if you still have not received your money.

You can also use the Federal Trade Commission

Ive had the same problem before when dealing with a seller on ebay. You can open up a complaint through ebay and the seller has an X amount of days to respond to it. If not, ebay will start taking legal action. They're very good about that so I don't think you should worry.

Ebay does have a good security plan. Beside it will be a question of reputation for ebay.

Well guys turned out i screwed myself by sending it to a addres the seller gave me through my ebay account and not the one on his paypal account,thanks all for the responses.

So he is going to claim he never received it back? Did you request delivery confirmation on the return package?

Paypal is saying that isn't the address he has on his account.

File the claim with eBay, they will check into it better than Paypal anyway. Did you look to see his feedback, see if there were others saying they had issues?
