  • Credit Report error

I had a car loan for my car. While paying it off, I got into a car accident and my car was wrecked so my my insurance company called it as a lose and were going to pay it off. During this whole process, I got my next car payment was due. I didn't pay it because my insurance company was cutting the check to pay it in full, but now on my credit report it state that i was late 30+ days. The loan is paid in full and i dont own anything.

Can i do anything about this?

Probably not... if the payment wasn't made on time... you were late.

Was she responsible for that payment though?

Unfortunately OP is responsible for the payment, yes.

She may be able to call the loan company to convince them to change the status on the credit report, but I wouldn't hold my breath.

In hindsight, you should have made the payment and if your insurance compnay paid it in full at the payoff amount (overpaid), you would have got a refund from the car finance company.

You can get the company to remove the error

Call the bank who loaned you the money, and explain the situation. If you have a good history with them (and no other delinquencies), they will probably change your account to show it was not 30 days late. If they don't do it over the phone, write a formal letter requesting that it be changed and wait for their reply. If they won't remove the negative remark, then you're stuck with it.

If the bank fixes the account, now you have to get your credit report fixed. Write dispute letters to each of the credit bureaus, or dispute it online. They will contact the bank to see if the account status has been changed, and remove it from your credit report.

Good luck, and let us all know how it goes.
